Workforce pressures drive sharp rise in employment risk for care providers

As workforce pressures continue to intensify across the UK care sector, TL Dallas is warning providers not to overlook one of the fastest-growing areas of operational risk – Employment Practices Liability (EPL).

Often incorporated within broader Management Liability insurance, EPL insurance cover is becoming increasingly important as care organisations navigate chronic recruitment shortages, high staff turnover and growing workplace pressures. Industry experts say the current operating environment is creating the “perfect storm” for employment-related disputes and tribunal claims.

One of the key pressure points is recruitment itself. However, experts warn that rushed recruitment procedures can increase exposure to allegations of discrimination, inconsistent selection processes and unfair hiring decisions.

Claims involving age, disability, nationality or other protected characteristics are becoming more common across the wider employment landscape, particularly where candidates believe recruitment decisions lack transparency and consistency.

The sector’s growing reliance on agency and temporary staff is also creating additional complexity. Disputes around worker status, supervision responsibilities and unequal treatment compared to permanent employees can all result in employment tribunal proceedings.

At the same time, sustained staffing shortages continue to place immense pressure on existing teams. Longer shifts, heavier workloads and reduced rest periods are contributing to increased reports of workplace stress and burnout. In some cases, this can escalate into constructive dismissal allegations where employees resign citing unsafe or unsustainable working conditions.

Rico added: “Care providers are operating in exceptionally demanding circumstances, and many teams are stretched beyond capacity. Claims often arise where employees feel unsupported or procedures are not followed consistently. EPL insurance provides an important layer of protection during these situations.”
